Federal Judge: Whitaker Can Use Boys Room For Now

Ash Whitaker will be able to use the boys bathroom-at least for the time being. A federal judge has issued a preliminary injunction ruling that KUSD cannot stop the transgender student from the boys facilities. Whitaker is a biological female that identifies as a male. Attorneys for the district say they will appeal to the Seventh Circuit Court of Appeals. Whitaker’s situation came to public attention earlier this year when he ran for Prom King at Tremper High School. The story quickly became about Whitaker’s desire to use the boy’s room, something he says he did without issue during the first semester of last school year. Whitaker and his mother filed suit against the district earlier this summer, accusing Kenosha Unified of discrimination.
